The effects of the ENC+ Directive in the Spanish legal system

Abstract

ENC+ Directive (arts. 2.1.1 and 2.1.2) and Regulation 1/2002 (arts. 35.1 and 35.2) clearly contemplate the possibility of a Member State having more than one authority administrative jurisdiction. This is precisely the situation in Spain, which constitutionally has a decentralized administrative system for the defense and promotion of competition.
