Enforcement of judgments and the Valdecañas case

Abstract

The present work analyzes the jurisprudential evolution referred to the well-known case of the illegal urban development built in Valdecañas. The project was presented as an action for socioeconomic development of the area. However, it affected land with ecological values worthy of protection that were not duly taken into account in its creation. They are analyzed from the first Court judgments, which motivated the condemnation of the original urban development project for flagrant violation of
environmental regulations, to the latest judgments that determines the degree of the duty to enforce the
judgments condemning the initial illegality once had built part of the original project
