The prominence of general principles in the Italian Code of Public Contracts

Abstract
Seven years after the approval of Legislative Decree number 50 of 18 April 2016, Italy enacted a new Public Procurement Code: Legislative Decree number 36 of 31 March 2023. The Code stands out both for its innovative content and for its particular approval process. This study aims to analyse one of the most important changes introduced by the regulation: the inclusion of the catalogue of general principles that should guide public procurement and the behaviour of those operating in the sector, paying particular attention to the role of each of them and how they should relate to each other.
