Abstract

In this study we have tried to analyze the main problems that, in our opinion, arise from the administrative concession regime of waterfalls for the purpose of hydroelectric power generation. We observe a clear decantation of the system towards a series of dominant positions on the part of one of the intervening sectors, partly justified by article 43 of the Italian Constitution, although this clearly goes against the regulation of free competition of the European Union.
