Environmental limitations on the occupation of urban space and the protection of criminal law: a case study

Abstract

The present study consists of a case study whose objective is to treat with the controversial theme of environmental limitations opposed to the occupation of the Brazilian urban space, and how the Criminal Law has contributed to the protection of the sustainable environment. Subsidiarity it seeks to determine, in the light of the specific case, whether it is possible to speak in right acquired in matters of administrative acts constituted to analyze and make feasible real estate development. This study concluded that the irregularities present in the environmental licensing are capable of configuring crimes that should be punished.
