The protection of the cultural heritage from the planning law

Abstract

This paper analyzes that measure the planning law constitutes one enough legal framework to provide the historical-artistic real estate, aside from the specific arrangements of the law of cultural heritage. In this sense, the urban planning legislation gives councils substantial powers for the protection of cultural value located in the munici- pality. Unlike with the rules of national heritage which includes of its aim of protection by its recognized value likely to be transmitter of knowledge of the history of mankind, the urban development considers it one more element –along with the agricultural, forest, natural, etc.– that gives coherence to the environment in which they are.
